Time To Indict Michael Flynn At The State Level

Michael Flynn is now refusing to cooperate with prosecutors as required under his plea deal. His deal doesn't cover much of the activity that he and his son engaged in. His son wasn't prosecuted as part of the deal. Not all of the details of their criminal activity have been made public. Prosecutors should go after both Michael Flynn and his son at the state level for any crimes they may have committed where they can't be pardoned. These could include conspiracy to kidnap an exiled Turkish cleric living in Pennsylvania on Turkey's orders. Prosecutors can also charge him with treason at the federal level for providing aid and comfort to ISIS on Turkey's orders. It would be politically tough for Trump to pardon a guy charged with treason for helping ISIS. It could also get Flynn the death penalty. It might also be tough for a judge to give him a light sentence if he's found guilty of treason.


Similar measures should be applied to other Trump allies. Michael Cohen provided limited cooperation and gets to serve a three year sentence in America's cushiest prison. Charge him with state and local crimes just like Paul Manafort, and he'll be under real pressure. Manafort won't make a deal until he's actually convicted in New York state court unless he'll just never make a true deal with prosecutors. Prosecutors should charge him in several other states as well. He also worked to close American bases in Kyrgyzstan on behalf of his Russian bosses. Actions taken against these bases, which supported the American military against the declared enemy of Al Qaeda was treason. Federal prosecutors could indict him for treason and seek the death penalty. The political ramifications of a light sentence or a pardon would make that move by Trump or a Republican judge unlikely.


The bottom line here is make these guys suffer. This isn't about cruelty. It's about ensuring that they cooperate. Unless there is a painful price to be paid, they'll keep doing whatever they want. The moment there are harsh consequences, expect them to crack. And if they don't, the next Trump minions will.
